@rahlyrah: I'm assuming you have already asked your guardians and they have accepted. So yes, next step is to get a will. I think some people here have mentioned making their own online for a limited cost? We went to an attorney for a full estate plan (wills, living wills, power of attorney and medical proxy documents).

If you don't mind my asking, how much did the full estate plan cost? It would be beneficial to have POA and medical proxy documents as well.

@rahlyrah: I don't know about cost (we need to do all this but haven't yet), but your choice of guardian has no legal standing until you put it in some sort of legal document. A will is the most common way to do that. In the absence of some type of legal document setting out your intentions, a court would usually try to place a child with family members (if possible) using a "best interests of the child" analysis. So you definitely want to get something in writing! The laws about what exactly you need to do to make it valid vary from state to state, so it's usually a good idea to consult someone familiar with the laws where you are.

We pay monthly for a legal plan at work, it's like $30 a month and it covers a full estate plan. We used the attorneys for our house closing and they were fantastic. Do you have the option for something similar in your work?
