I'd imagine it varies state to state on the law, and even within a state different hospitals might have different policies. I'd call and ask the rules!

My husband had a contractor working for him names a Baby Boy because his parents couldn't decide. True story, saw the paperwork myself.

@blackbird: ha! It won't be that bad. We think we have a first name. We cannot come to consensus on the middle name.

Many of the births I've photographed have been this situation. I had a client go 10 days without a name. They let them leave.

Can you just not have a middle name and do a name change later to add it when you agree on the middle name?

According to our hospital, they push for you to name before you leave because then the hospital will submit all the paperwork and you don't have to pay or deal with that hassle (well I imagine it is somehow charged to insurance but you know what I mean!). You can do it yourself, it's just a pita.
We didn't have a name until the day after LO was born and the nurses were definitely getting pushy!! Haha

@Mrs. Jacks: Um LO's daycare friend's mom had twins in December and didn't name them until last week! So don't stress! I think they go home as "baby boy" and then she had to go to social security and file the paperwork for the real names and update it with her health insurance. If you do the paperwork at the hospital then they file it with social security and you don't have to worry about it.

My hospital filed the paperwork for us, but we had the option to take it and file it ourselves. No idea of the time limit, but the option is available!

I think if you have a first name, you can have the hospital file for your birth certificate and then you can add a middle name by filing an amendment to change a record with a notary.

Have you thought about two middle names? Or is that out?
I think it would be so hard to name a kid after they are born. Much easier for them to slide into their name than to try to pick one that encompasses all of their cute babyness you learn about in those first few days.

@jedeve: we've used my last name as a second middle name, but I suppose we could sacrifice the spot to a delicious middle name :). It would just be weird that the girls have it and he doesn't.

You could probably leave without a middle name and then add it at a later date - you'd just have to go through all of that process to change it with SS and the State, which could be a hassle.

@Mrs. Jacks: oh I don't think that's weird at all! I would give a daughter my maiden name as a middle. Maybe it's different if you kept your last name instead of taking your husband's though. But having a special mother daughter thing is fine too!

I think it depends on your hospital. I know one family who had to stay an extra day because they didn't have a name picked out, and the hospital wouldn't let them leave until they did. I know another family who didn't fill out a birth certificate until a year after the birth (they thought of and used a name before that, just never got around to doing the paperwork.)
