I've been reading that the Supreme Court is expected to make a decision re: same-sex marriage by the end of the month, but it could possibly happen as early as today.
Anyone else anxiously awaiting their ruling? Do you think they'll rule in favor of same-sex marriage? I have a feeling they will.

I'm looking forward to it because I think they'll rule in favor, but I'm actually more "anxious" about the subsidized healthcare ruling.... I feel like that could easily go either way!!

I'm waiting on these two rulings that are left, and I'm nervous. I am more fearful of the reaction that the losing side is going to have than the actual ruling itself.
@lawbee11: I heard a court watcher reporter talk about CJ Roberts' questioning if gay marriage bans could be viewed as sex discrimination. The reporter said that based on his previous rulings, she thought he would rule in favor of gay marriage on this basis. I found that a really interesting and compelling idea, one that I hadn't thought of before. I am no lawyer, but I think that might still leave room for religious exemptions, which is what I'm mostly interested in. Had you heard this? Thoughts?

@DesertDreams88: yeaaaaah, that could very quickly be a hot mess. If they rule against, then opponents are going to claim "victory," but really, no one wins there.

@LovelyPlum: I remember reading about Roberts's questioning after oral arguments. I hadn't thought of it as sex discrimination either but the argument makes sense. I'm curious to see which side Roberts will fall on, though I think Kennedy will most likely rule for same-sex marriage so Roberts's vote wouldn't be the deciding vote (I would love if it were a 6-3 decision, though!).

I'm so excited for the ruling, honestly I will be so disappointed if it doesn't pass, it will be a step back for equal rights for sure.

@lovelyplum: exactly... Crazy that four small words could endanger the possibility of health insurance for 6+ million people. And the health insurance industry has already been through so much turmoil.
Noe: I'm not downplaying the significance of the gay marriage ruling, just a lot more confident about that one! The hodgepodge of marital laws across the country is ridiculous and backwards.

@DesertDreams88: right. I'm not claiming that Obama care is perfect, awesome, or ideal. I am saying, though, that it is better than nothing, and certainly better than suddenly yanking insurance subsidies away from 6 million people. I just can't even imagine the chaos.
And I'm not downplaying either ruling. The next week is going to be craaaazy, regardless. Things are about to get real on both fronts.

@sarac: Yep! They're done issuing opinions for the day. Nothing on ACA or same-sex marriage was issued yet..boo! Next chance would be this Thursday. I believe next Monday is the last day they'll be issuing opinions. So we should know by either Thursday or a week from today.

Very happy with this decision. My heart would have broken to think of all the people who would have lost their healthcare (though it certainly would have been entertaining to watch Republicans deal with the backlash from so many of their constituents.)

@MrsLonghorn: That would totally be the cherry on top for me! I follow SCOTUSblog and they all have their money on Roberts writing the opinion. Maybe even if that's the case RBG will write a concurrence.

I just saw that SCOTUS added a session for tomorrow to release decisions. I wonder if that means the same sex marriage case will come down then?

@LovelyPlum: I think they added it because they still have so many opinions to release (5) and not specifically because they're planning to release the same-sex marriage opinion tomorrow (though I hope they do).

Btw, have you read the dissent yet? You should. The news is focused on his use of the term SCOTUScare, but I rather liked his use of the phrases "jiggery-pokery" and "pure applesauce" better

Holding: Fourteenth Amendment requires a state to license a marriage between two people of the same sex. And to recognize a marriage between two people of the same sex when a marriage was lawfully licensed and performed out of state. 5-4 decision.

That's awesome! Now, same sex couples can just as easily get divorced just like opposite sex couples.
SCOTUS has been on a roll with these decisions.
