If it was repaired and they thought it was fixed I'm not sure that's a problem? In my state we wouldn't be required to disclose that. Only major defects, shower repair wouldn't qualify. Particularly since I'm guessing you can't prove they didn't know it wasn't fixed. They could provide proof of repair and then I would imagine they thought it was taken care of. Although if you call them and ask who did the work maybe you could have some recourse with the plumber

@Foodnerd81: I hear you we had a window installed crooked and it was like pulling teeth to get it fixed. Everyone said it was someone else's problem. So depending on the cost of this, I would just fix it for a timely resolution.

@Foodnerd81: This sounds similar to something we went through. First morning in our new house, I took a shower, DH took a shower, and then when we went downstairs, we noticed a huge wet spot on the ceiling below the bathroom. Got a plumber in and he immediately noticed that the shower faucet upstairs had a layer of what he called temporary caulking to seal it. Some water was already leaking through, and as soon as he cut through it, a ton more water came out. The plumber said the seller definitely knew it was a problem, which is how it got sealed over, but they didn't fix it, they just hid it. He was actually pretty aghast that the inspector didn't notice it and told us to try to sue either the seller or inspector.

In the end, we went back and forth for awhile with our RE agent and the seller's agent. The seller claimed she only used the 2nd floor rooms and bathroom and not the 3rd floor one due to her health and inability to get up too many stairs, and we couldn't really prove otherwise, especially since the wet spot on the ceiling didn't appear until we moved in. We also remembered that the inspector tested that shower and it had seemed fine with no leaks around the faucet. Our agent finally advised us to let it go so we did. It sucked but we didn't think it was worth the hassle to sue.

The other thing that swayed us was that the seller left us a note with her handyman's contact info, saying he'd done a ton of work for her over the years. It was obvious this guy was a total hack but I think she genuinely thought he was good, so maybe she really did think he fixed the issue.
